The Involuntary Commitment Expungement Process
Under 18 Pa.C.S. Section 6111.1(g)(2), a person committed under the Mental Health Procedures Act can petition the Court of Common Pleas to review whether the evidence behind that commitment was sufficient. If the court agrees it was not, it can order the record expunged from the Pennsylvania State Police system, restoring both state and federal firearm rights. This type of petition must generally be filed within six years of the commitment. If the commitment was properly supported and expungement is not available, restoration of firearm rights may still be possible through a separate petition.
